What is Required of Contractors? | Blog No. 13


Some of the worst process safety incidents have been caused by untrained contractors. When it comes to PSM facilities, the hands-off approach to contractors is unacceptable. Here is an overview of the contractor requirements found in Title 40 CFR §68.85 and Title 29 CFR §1910.119(k):


The contractor requirements in PSM do not apply to all vendors who come onsite. This element is specifically looking at contractors who work on or near the covered process (e.g., ammonia refrigeration system). Here are some examples provided of vendors who are exempt from these requirements:

  • Janitors

  • Food and drink suppliers

  • Laundry suppliers

  • Delivery drivers

  • Other suppliers

The PSM standard breaks the contractor requirements into two (2) categories: items the facility is responsible for and items the contractor is responsible for.


When selecting and working with a contractor, the facility must obtain and evaluate information on the contractor's safety performance, inform the contractor of known hazards related to their work and the process, explain relevant safety provisions, develop safe work practices, and periodically evaluate the contractor's performance.


Contractors, on the other hand, are responsible for ensuring that their employees are properly trained in safety practices and aware of potential hazards related to their job and the process. They must document the training received by each employee and make sure that they follow the safety rules and practices of the facility. Additionally, contractors are required to inform the facility of any unique or newly identified hazards related to their work.
